Even a huge and powerful company as Apple may be sued at some point. What might the reason be? The iTunes downloading technology patents are said to be unlawfully used by Apple. Let’s see who sues who and why in the next.
Apple Inc. gave a big hit in the music and technology market when they came up with the idea of the ipods. Currently, Apple Inc. is the second best music retailer in the entire US, being surclassed only by the Wall Mart Stores Inc. Even if the method of using the ipods and downloading the iTunes for a sum of money seemed a procedure to work and stay strong, there are certain fallacies regarding the apple ipods and especially the iTunes.
Zap Media Services Inc, a company based in Atlanta has found out that Apple Inc. is presently using some patents that enable people to download iTunes for their Apple ipods that belong to Zap Media Services Inc. The Atlanta based company has got the downloading patents for iTunes in question for about two years now, and is willing to get some profits from these by suing Apple Inc. The Zap media Service Inc. asks for some credits form the Apple ipods and iTunes, which by the way is a very profitable business, reaching about 11 billion dollars for 2007 only.
But is Zap Media Services Inc. entitled to sue Apple Inc. for those patents? Those patents are in fact methods to sending iTunes and other media or digital contents from a server to the clients with iPods and other media players. However, these methods of getting an iTune for instance from a server directly on a media player can be valid for myriad other companies, so Zap Media Services Inc. might just try their luck at suing Apple Inc. Is a big name such as Apple and the famous ipods using illegitimately the patents to download the iTunes?
A meeting has already taken place involving representatives from Apple Inc. and representatives from Zap Media Services Inc. and the latter company was willing to bargain on the licensing rights. However, the representatives for Apple Inc. were by far uninterested by the offer.
Zap Media Services Inc. is determined to defend their patenting rights, and will go farther if that is needed. Meanwhile, Apple Inc. does not want to discuss any details of the lawsuit until this will be finalized.
